The RIDDOR deadlines that catch people out

Deaths, specified injuries, dangerous occurrences and reportable diseases. The HSE must hear from you immediately, with the written report following within 10 days.

Over-seven-day injuries to workers. This is the one that slips: the absence often passes seven days weeks after everyone has moved on from the accident.

And note the gap between recording and reporting. More than three consecutive days off makes an injury recordable under regulation 12; it only becomes reportable once the absence passes seven days.

What has to be reported under RIDDOR?

Deaths, specified injuries such as fractures and amputations, injuries causing a worker more than seven consecutive days off work, certain occupational diseases, dangerous occurrences listed in Schedule 2, and injuries to members of the public that result in them being taken to hospital for treatment.

How long do I have to report a RIDDOR incident?

Deaths, specified injuries, dangerous occurrences and reportable diseases must be notified to the HSE without delay and reported within 10 days. Over-seven-day injuries have 15 days from the date of the accident and do not require a phone notification.

Is a three-day injury reportable?

No, but it is recordable. An injury that keeps a worker off for more than three consecutive days must be recorded under regulation 12, even though it only becomes reportable once the absence exceeds seven days.

Do the seven days include weekends and days off?

Yes. The count is of consecutive days on which the worker could not do their normal work, and it includes weekends, rest days and bank holidays. The day of the accident itself is not counted.

Does a customer slipping in my restaurant need reporting?

Only if the accident arose out of or in connection with work and the person was taken directly from the scene to hospital for treatment of that injury. If they were not taken to hospital, it is not reportable under regulation 5 - though you should still record it.
